SECTION 2 - GOVERNING LAW AND JURISDICTION
These Terms of Service and any separate agreements whereby we provide you products or services shall be governed by and construed in accordance with the laws of the Province of Ontario and the federal laws of Canada applicable therein.
By purchasing from this site, you agree that any legal disputes or claims arising out of these terms shall be subject to the exclusive jurisdiction of the courts located in Ottawa, Ontario, Canada.

SECTION 3 - INTERNATIONAL ORDERS, DUTIES, AND CUSTOMS
If you access this site or place an order from a location outside of Canada, you do so on your own initiative and are responsible for compliance with local laws.
  • Import Duties & Taxes: All international orders may be subject to import duties, taxes (such as VAT or GST), and customs clearance fees levied by the destination country.
  • Customer Responsibility: These charges are not included in our product prices or shipping fees. You, the customer, are the importer of record and are solely responsible for paying all fees, duties, and taxes required by your local customs authority to release your package.
  • Customs Delays: We are not responsible for delivery delays caused by international customs processing, border inspections, or carrier handling outside of Canada.


SECTION 4 - PRICING, CURRENCY, AND CONTRACT FORMATION
  • Currency Disclaimer: All prices are displayed in Canadian Dollars (CAD). If you browse in a local currency using a currency converter, the final checkout amount will be processed in our store's base currency. Your bank or credit card issuer may charge additional foreign transaction or conversion fees.
  • Contract Formation: Your receipt of an electronic order confirmation does not signify our acceptance of your order. We reserve the right to decline or cancel your order at any time for reasons including product unavailability, shipping restrictions to your country, or errors in pricing. If we cancel an order, we will issue a full refund to the original payment method.

 

SECTION 5 - CANADIAN SALES TAX
For domestic orders shipped within Canada, applicable Federal and Provincial sales taxes (HST, GST, PST, or QST) will be automatically calculated and added at checkout based on the shipping destination province. No Canadian sales taxes will be charged on orders shipped directly to international addresses outside of Canada.


SECTION 6 - COMPLIANCE WITH LOCAL LAWS AND EXPORT CONTROLS
You agree to comply with all applicable import and export laws and regulations of Canada and your destination country. We reserve the right to restrict or prohibit sales and shipments of any product to any person, geographic region, or international jurisdiction at our sole discretion.


SECTION 7 - PRIVACY AND INTERNATIONAL DATA TRANSFERS
By using our store, you acknowledge that your personal information will be transferred outside of your home country to be processed in Canada and the United States by our e-commerce platform provider, Shopify. Your data will be protected in accordance with Canadian federal privacy laws (PIPEDA) and our Privacy Policy.

SECTION 8 - LIMITATION OF LIABILITY
To the maximum extent permitted by applicable law, Amerith shall not be liable for any direct, indirect, incidental, or consequential damages resulting from international shipping delays, customs seizures, or your inability to import our products into your country.
